Are Vaccine Passports Illegal?

There is a medical privacy law in the USA. It mandates that PHI Personal Health Information must be protected and kept private.

Vaccine Passports scream your medical status to the world around you. It seems to me this violates HIPPA.

Most of us believe that our medical and other health information is private and should be protected, and we want to know who has this information. The Privacy Rule, a Federal law, gives you rights over your health information and sets rules and limits on who can look at and receive your health information. The Privacy Rule applies to all forms of individuals’ protected health information, whether electronic, written, or oral. The Security Rule is a Federal law that requires security for health information in electronic form.

Access
Only you or your personal representative has the right to access your records.

A health care provider or health plan may send copies of your records to another provider or health plan only as needed for treatment or payment or with your permission.

The Privacy Rule does not require the health care provider or health plan to share information with other providers or plans.

HIPAA gives you important rights to access – PDF your medical record and to keep your information private.

I don’t want the world to know if I have a medical condition the prevents my getting the vaccination. Nor, for that matter, do I want to be telling the world I DID get the vaccination. It is MY private information.

Seems to me that vaccine passports are illegal.

    Schools require vaccine status for certain diseases here in California, even homeschool charters. Do I agree? No, but I have to comply.
    Side note: When I did a lot of volunteering in public school, I had to get tested for TB and provide the results to the school. My doc suggested a few extra vaccines like hepatitis just in case because, as he put it, “The little monsters catch and share EVERYTHING.”

    That’s the rub. Vaccines, once introduced, became “mandatory” locally for school use. Never mind that in low population areas, everyone knows everyone anyway; so when you got sick, everyone knew it. Vaccines were required for some occupations (yeah, if you work in a pathology lab …); but basically that was between employer and employee and not to be generally discussed, especially post-HIPAA where personally identifiable information was formally made private (outside of law enforcement/mandatory reporting of contagious diseases exceptions, and even then such could be done such that personal identifying information was minimized). So yes, my blue card became a part of my school records. My physicians also get updated status whenever I get one (last were the regular old folks ones). In everyday life, no one else needs to know that kind of information.

    The usual will happen: if you want a vaccine passport you will have to sign to agree that you allow your vaccine status will be shared in some approved manor.

    Once upon a time… every persons passport had a litany of vaccines required for travel, smallpox being the most strictly enforced. those of us of a certain age, that traveled internationally in the 50s and 60s remember this well, and you can still get a chuckle out of geezers and geezerettes when you show your smallpox welt, even now, 6+ decades later.

    You literally could not enter the US, irrespective of citizenship, or any other country, without proof of vaccination for x, y and z.

    And we eradicated most of those diseases.

    I remember the insistence on having certain ‘jabs’ for travel between countries – in the 1970s, when I got a job potentially including working overseas, the company insisted that I have a polio jab, despite the fact that I had had polio as a child, maybe 20 years previously. Presumably, this was the official insistence on ‘paperwork’, since the disease hadn’t actually stamped a form for them.

    Here in the UK, there are proposals about this flying all over the place at the moment. Should we open pubs again, but insist that people who want a drink must provide documentary proof of vaccination? Gyms, ditto? Supermarkets? And the really worrying thing is how many of the citizens of this once free country agree with every police state proposal that comes out. From my POV, the Gov has done its duty when it has offered me a vaccination, it has no right whatever to insist that I have one.

    Meanwhile, the cold’n’flu testbed that is Steve C continues in excellent health, no more than a couple of minor head colds in over a year despite a complete absence of ‘precautions’.

    I think I’m going to run with that one. Simply say my Religion FORBIDS the Mark Of The Beast and the vaccine passport is IT!

    Let them try to tell me what MY religion can and can not believe.

    Impact on my life ought to be near zero from saying “Up Yours!” anyway.

    1) I no longer fly around the USA. TSA and 2 hours to be strip searched electronically did that a few years ago. “Ban” me from flying? Fine with me…

    2) Can’t go into New York City? (Looks like NY is making their own version). Fine with me. I’d rather not ever spend a dime in their city again.

    3) Can’t eat in some expensive restaurant in some Dimocrat controlled city? Again, fine with me. I like my own cooking, don’t mind camping, and a drive up window at fast food is great going cross country.

    4) Can’t vacation in your Special Place? Well, I understand Florida is open for business and Texas is not going to put up with it either…

    Plus, I could use the money from the lawsuits… “denial of my civil and religious rights” and all that…

    It is an established… well, not exactly Presbyterian or Lutheran or Catholic or the usual suspects… religion, but it has formal recognition and standing.

    I saw an article recently where some pharmacy tech made a Tik-Tok video stupidly bragging about stealing some ‘vaccine passport’ cards and filling them out for her and her significant other. She ended up having to delete most of her social media accounts, and I can’t remember her job status because of her bragging. I have no problem with forging the cards, but bragging about it on social media is just idiotic. From what I’ve seen, people are printing their own, and then taking the data from people who post their cards online (bragging about getting the vaccine) and forging their own (they get vaccine name, lot number, etc.). Right now that’s really all you need to do if you can’t find real ones.

    So basically everybody getting vaccinated right now is just a guinea pig for big pharma. It makes me think of all those commercials for the latest drug from big pharma, where they list all of the possible side effects. Nearly everyone I know hears all the side effects and says “No way I’d take that!”. If they ran the same sort of commercials for the vaccines, listing all the side effects, most people would probably have the same reaction: “No way!”. But, without being aware of the side effects, people just rush out to take it. I just have to wonder why? It won’t prevent you from catching covid (it lessens the symptoms, but so does HCQ, Ivermectin and a few other things), it won’t prevent you from spreading it if you catch it, you still are expected to wear a mask and social distance, so what exactly is the point, other than to enrich big pharma.

    Last night the “wander through YouTube Recommended” (which I use now as a way to gauge the stuff being pushed by EewTube as they bias the algorithm…) had several on offer about the “3rd Wave!!! GASP!” of Chinese Wuhan Covid… Seems Ontario Canada is nearly out of hospital beds. (Well, in fact Herr Doktor they had on went out of his way to say “STAFFED beds, we have empty beds, just not the staff for them”… so it’s really a staff shortage not a bed shortage…)

    Yet Florida and Texas are not showing surges (while New York on worldometer is showing a little uptick).

    Which puts me back into the mode of wondering “How do we know what actual case level is?”.

    The E.U. nations (or ought we just call them “States” now?) seem to be having issues. Netherlands showing a big “3rd Wave!!!”… yet Portugal is showing a nice “tailing out” with dropping cases and even Mexico is ramping down.

    So I’m left to wonder: What the heck is the ‘deal’ here? Differential exposure? Variants? Differential reporting? History of being locked up so the “3rd Wave” is just “we are finally getting exposed” while other countries are already “so over this”?

    Given that EewTube is a major propaganda outlet now, my “scales balancer” says the story of a “3rd Wave” is exactly that. A story for effect. That some EU States are showing surges is as much an artifact of their lockdown history and testing methods as anything real. I don’t buy the tag line that it’s all due to “new more infectious variants” or “the UK variant” for the simple reason that California is supposedly a hot bed of the UK Variant and we continue to drop toward gone. Daily new cases now down to 2500 from a peak of 61,000 mid December and a full 5000 at the start of this month.

    So anyone in the EU or UK have “on the ground” knowledge of stuff and can say if there really IS a “3rd Wave” crashing over y’all, or if it is just hype?

    As an older disabled Veteran, I was at the front of the line. When called about coming in for that shot, I said, “No thanks, I’d rather not.”
    I see no reason to be a Lab.Rat for Fauci and Gates Grand Experiment.
    People are being lead to believe that they will get their freedoms back if they get the Shot!
    Fauci and Gates say, No way, this is the new normal.
    Hospital IC beds are in short supply because so many of the staff are felled by the inoculation, The numbers being Reported for Covid-19 are being bloated by counting Bad outcomes from the vaccination ! and we haven’t even seen what long term complications might result.
    I’ll stay with my vitamin regime. Thanks, but NO THANKS ! .
